Consumer Health Data Privacy Policy
This policy is published under the Washington My Health My Data Act, Nevada SB 370 and similar state laws. It explains how Jagssoft, LLC ("we", "us") handles "consumer health data" in the Fitness Sidekick app and website. Those laws define the term broadly: personal information that identifies, or can reasonably be linked to, a person's past, present or future physical or mental health. This policy supplements our main Privacy Policy.
Consumer health data we collect
- Body measurements and characteristics: age, gender and weight.
- Injuries, pain and physical limitations you tell us about during onboarding, in check-ins or in chat.
- Fitness goals and activity: goals such as weight loss, workouts you complete or skip, how hard they felt, streaks and progress.
- Diet and nutrition: eating pattern, dietary preferences and allergies, calorie targets, meal plans and recipe ratings.
- Apple Health data, if you connect it: your step counts.
- Anything health-related you write to the coach, such as sleep, energy, soreness or mood.
- Inferences the coach makes from the data above to tailor your plan, such as your fitness level or how your training should progress.
Where it comes from
Directly from you, in the app. From Apple Health, only if you connect it and only for the categories you allow. From the coach and our planning features, which generate your plans and inferences from that information.
Why we collect and use it
Only to provide the Fitness Sidekick features you ask for: building and adapting your workouts and meal plans, writing the coach's replies and voice lines, tracking your progress, and keeping the service secure. We don't use consumer health data for advertising, we don't sell it, and we don't use it to make eligibility decisions about insurance, credit, employment or housing.
Your consent
We collect and use consumer health data only after you agree to it in the app. You're asked when you sign in, on the screen where you enter your code, before any health question. The box is unticked until you tick it, and no code is accepted until you do. It reads:
"I agree to the Terms, Privacy Policy and Health data policy, including use of my health info and Google's AI to write my coaching."
By ticking it you agree to us collecting the health data listed above to build your plan and coaching, and to sharing it with our AI provider, Google, to generate that coaching. We record which version of this policy you agreed to and when.
You can withdraw your consent at any time. Delete your account in the app (Profile & Settings → Delete account), or email privacy@myfitnesssidekick.com and we'll stop collecting and using your health data. Because your coaching depends on it, the coach can't keep building your plan without it. You can also disconnect Apple Health in Settings or in the Health app.
Who we share it with
We share consumer health data only with the processor below, under contracts that limit them to providing the service for us:
- Google LLC (Gemini API): receives the health details needed to generate each coach reply, plan or meal suggestion.
Our hosting providers store this data on our servers on our behalf. They don't use it for their own purposes.
We don't sell consumer health data. We don't share it with advertisers, data brokers or anyone else, except where the law requires it.
Your rights
- Confirm and access: ask whether we collect, share or sell your consumer health data, and get a copy of it along with a list of every third party and affiliate we've shared it with, including their contact details.
- Delete: delete it in the app (Profile & Settings → Delete account) or by emailing us. We'll also tell our processors to delete it.
- Withdraw consent to collecting or sharing it at any time.
- No discrimination: we won't treat you differently for using these rights.
How to make a request: email privacy@myfitnesssidekick.com from the address on your account, with "Health data request" in the subject line. We'll respond within 45 days. If the law allows an extension, we'll tell you why we need one. If we decline your request, you can appeal by replying with "Appeal" in the subject line. We'll respond to the appeal within 45 days. If we deny the appeal, you can contact the Washington State Attorney General at atg.wa.gov/file-complaint, or the Attorney General of your state.
